Immigration Emergency Readiness Retainer Terms

1. Enrollment and attorney-client relationship
Submitting information or payment does not by itself create an attorney-client relationship. Enrollment is effective only after Darian Immigration Law PC completes its review and conflict-clearance process, accepts the engagement, and both the client and the firm execute the applicable written engagement agreement.
2. Membership tiers and pricing
The program is offered in the following three tiers. The benefits, availability period, and authorized-contact limit for the selected tier apply only while that membership remains active.

Monthly charges renew automatically until canceled in accordance with the written engagement agreement. The one-time onboarding fee is charged in addition to the first monthly payment unless a valid promotion expressly changes that charge.
3. Services included in each tier
Prepared
Prepared includes one enrolled adult, one authorized emergency contact, an emergency profile, access to the designated activation channel, and availability from 9:00 a.m. to 5:00 p.m. Eastern Time, Monday through Friday.
Travel Ready
Travel Ready includes the Prepared services, permits two authorized emergency contacts, and allows registration of up to four international trips per membership year. Availability includes 9:00 a.m. to 5:00 p.m. Eastern Time, Monday through Friday, plus the registered travel windows accepted by the firm. Travel registration is not complete until the firm receives and confirms the required itinerary and check-in information.
Priority Readiness
Priority Readiness includes the Travel Ready services, permits three authorized emergency contacts, allows registration of up to eight international trips per membership year, and provides 24/7 availability through the designated activation channel. It also includes preparation of one financial power of attorney naming one designated emergency contact and secure storage of sensitive original documents accepted by the firm, subject to the client’s written instructions and the engagement agreement.
4. Onboarding
The onboarding process includes an intake to gather client information, the identification of authorized emergency contacts, creation of an emergency profile, and setup of the designated activation process. Sensitive documents and immigration information must be provided only through the secure method designated by the firm.
5. Activation services
When the plan is properly activated, the firm will use the prepared client information and undertake detention-location identification once the client appears in the ICE detainee locator system or the firm receives information regarding the client’s location. As soon as the detention location is identified, the firm will promptly connect the client and authorized emergency contacts with a law firm that is available to advise regarding detention defense, including bond or habeas petitions.
6. Independent detention counsel
Darian Immigration Law PC does not provide the detained removal-defense, bond, or habeas representation through this program. Any receiving law firm must independently evaluate the matter, clear conflicts, agree to representation, and enter its own engagement agreement. The receiving firm charges its fees directly, and those fees are not included in the membership or onboarding charge.
7. Client information and authorizations
The client agrees to provide accurate, current information and to update material changes. The client authorizes the firm to communicate with the emergency contacts identified during onboarding and to securely transmit authorized portions of the client’s emergency file and activation instructions to independent counsel for purposes of activating the plan and facilitating a connection. For Priority Readiness members, stored original documents may be shipped or released to an authorized emergency contact according to the client’s verified instructions.
8. Government information systems
Government detention records may not appear immediately. The timing of location identification can depend on when ICE or another government source publishes or provides information concerning the client’s location.
9. Priority Readiness document services
The Priority Readiness tier includes secure storage of sensitive original documents accepted by the firm, such as passports, property titles, and original certificates. While the client is detained, the firm will ship the stored documents or make them available according to the client’s verified instructions and the release procedures stated in the engagement agreement. Preparation or storage of a power of attorney does not guarantee that any bank, financial institution, government agency, or other third party will accept or act on that document.
10. Renewal, cancellation, tier changes, and refunds
The final engagement agreement will state the effective date, automatic-renewal terms, how to cancel, when cancellation takes effect, and the treatment of monthly and onboarding fees. Those provisions must be completed and approved before this program accepts live enrollments.
Any upgrade, downgrade, or other tier change is effective only after confirmation by the firm and may require updated onboarding, authorizations, fees, or payment information. Unused emergency-contact slots, travel registrations, document services, or availability periods do not roll over or create a cash credit unless the engagement agreement expressly states otherwise.
11. No promise of a case result
The program facilitates preparedness, location identification, and a connection with available independent counsel. It does not promise any particular decision in immigration proceedings, eligibility for bond, release from custody, or other legal outcome.
12. Controlling agreement
If these website terms differ from a signed engagement agreement, the signed engagement agreement controls to the extent permitted by law.
